Welcome to Handy. These Terms of Service ("Terms") govern your use of the Handy mobile app, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Who we are
Handy operates a marketplace that connects homeowners ("Customers") with independent service professionals ("Pros"). Handy is not a contractor and does not perform services itself. Pros are independent third parties, not employees or agents of Handy.
2. Eligibility & accounts
You must be at least 18 years old to use Handy. You're responsible for keeping your account credentials secure and for all activity under your account. Provide accurate information and keep it up to date.
3. Marketplace role
Handy enables Customers and Pros to discover, communicate, and transact. Any contract for services is solely between the Customer and the Pro. Handy does not guarantee the quality, safety, legality, or completion of any job.
4. Fees and payments
Posting a job is free. Pros pay a success fee only when a Customer awards them work, as disclosed in the app. All fees are non-refundable unless stated otherwise. Payments are processed by third-party processors subject to their terms.
5. AI features
Handy provides AI-generated job descriptions, price estimates, proposals, and similar outputs. AI output may be inaccurate or incomplete and is provided for convenience only. You are responsible for reviewing AI output before relying on it.
6. Acceptable use
- No fraudulent, illegal, harassing, or deceptive behavior.
- No circumventing fees or taking transactions off-platform after being matched.
- No scraping, reverse engineering, or interfering with the Service.
- No posting content that infringes intellectual property or privacy rights.
7. User content
You retain rights to content you submit (photos, descriptions, reviews). You grant Handy a worldwide, non-exclusive, royalty-free license to host, display, and use that content to operate, improve, and promote the Service.
8. Reviews
Reviews must be honest and based on real experience. Handy may remove content that violates these Terms.
9. Suspension & termination
We may suspend or terminate your access at any time for violations of these Terms, suspected fraud, or risk to other users. You may close your account at any time.
10. Disclaimers
The Service is provided "as is" and "as available". Handy disclaims all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. Handy is not responsible for the acts, omissions, or workmanship of Pros or Customers.
11. Limitation of liability
To the maximum extent permitted by law, Handy's total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the fees you paid to Handy in the 12 months preceding the claim or (b) USD $100. Handy is not liable for indirect, incidental, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold Handy harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or any law.
13. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved by binding individual arbitration, except where prohibited by law. You waive any right to a jury trial or class action.
14. Changes
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the Service after changes means you accept the updated Terms.
