Handy may allow users to:

Handy is not:
- a contractor;
- a subcontractor;
- a construction company;
- a home services company;
- an employer;
- a staffing agency;
- an employment agency;
- a broker;
- a guarantor of work quality.
Handy merely provides technology services.
4. No Employment Relationship
Nothing in the Service creates:
- employment;
- agency;
- partnership;
- franchise;
- joint venture;
- fiduciary relationship.
Contractors remain independent businesses and are solely responsible for their activities.
5. No Guarantee of Jobs, Customers, Revenue, or Results
Handy does not guarantee:
- customer leads;
- project awards;
- job opportunities;
- quote requests;
- revenue;
- profit;
- business growth;
- rankings;
- visibility;
- response rates;
- conversions.
Past results displayed in the Service do not guarantee future results.
6. Marketplace Disclaimer
Users contract directly with one another.
Handy is not a party to any agreement between users.
Handy does not supervise, direct, control, or guarantee:
- services performed;
- project completion;
- workmanship;
- contractor behavior;
- customer behavior;
- payments between users.
All transactions occur solely at users' own risk.
7. Lead Quality Disclaimer
Leads, opportunities, inquiries, and customer requests displayed through the Service may:
- be inaccurate;
- contain errors;
- be duplicated;
- be outdated;
- fail to convert into paid work.
Handy makes no warranty regarding the quality, quantity, validity, or value of any lead.
8. Background Check Disclaimer
Unless explicitly stated otherwise, Handy does not perform comprehensive background checks, criminal history checks, licensing verification, insurance verification, financial screening, or professional qualification reviews.
Users are solely responsible for conducting their own due diligence.
9. Contractor Responsibilities
Contractors are solely responsible for:
- licensing;
- permits;
- insurance;
- tax compliance;
- workplace safety;
- legal compliance;
- consumer protection obligations.
Handy assumes no responsibility for compliance failures.
10. AI Services Disclaimer
The Platform may provide AI-generated:
- estimates;
- proposals;
- pricing recommendations;
- project descriptions;
- material calculations;
- business recommendations.
AI-generated content:
- may contain inaccuracies;
- may be incomplete;
- may be outdated;
- may be unsuitable for specific circumstances.
Users are solely responsible for reviewing and verifying all AI-generated outputs.
Handy makes no warranty regarding AI-generated content.
11. User Content
Users retain ownership of their content.
By uploading content, users grant Handy a worldwide, royalty-free, non-exclusive license to:
- host;
- process;
- reproduce;
- display;
- analyze;
- improve the Service.
Users represent that they possess all rights necessary to submit such content.
12. Payments
Certain features may require payment.
All fees are:

- payable in advance;
unless otherwise required by law.

Handy is not responsible for:

- third-party AI providers.

14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
HANDY DISCLAIMS ALL WARRANTIES INCLUDING:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- TITLE;
- NON-INFRINGEMENT;
- ACCURACY;
- RELIABILITY;
- AVAILABILITY.
WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
HANDY, ITS OWNER, CONTRACTORS, AFFILIATES, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
- LOST PROFITS;
- LOST REVENUE;
- LOST DATA;
- BUSINESS INTERRUPTION;
- LOSS OF GOODWILL;
- PERSONAL INJURY;
- PROPERTY DAMAGE;
- SPECIAL DAMAGES;
- INCIDENTAL DAMAGES;
- CONSEQUENTIAL DAMAGES;
- PUNITIVE DAMAGES.
IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE GREATER OF:
- (A) USD $100; OR
- (B) THE TOTAL FEES PAID BY THE USER TO HANDY DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
16. Indemnification
Users agree to defend, indemnify, and hold harmless:
- Handy;
- Iana Gushchina;
- affiliates;
- contractors;
- service providers;
from any claims, losses, damages, liabilities, costs, and expenses arising from:
- use of the Service;
- violation of these Terms;
- violation of law;
- disputes with other users;
- services performed through the Platform.
17. Mandatory Informal Dispute Resolution
Before initiating arbitration or legal proceedings, the user agrees to provide written notice describing the dispute.
Both parties agree to attempt informal resolution for at least thirty (30) days.
No arbitration may begin until this process is completed.

18. Binding Arbitration
ANY DISPUTE ARISING FROM OR RELATING TO THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION.
Users waive the right to:
- jury trial;
- court proceedings;
- participation in class actions.
Arbitration shall be conducted in English.
The arbitrator shall have exclusive authority to resolve disputes regarding interpretation and enforceability of these Terms.
19. Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
ALL CLAIMS MUST BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY.
NO USER MAY PARTICIPATE IN:
- CLASS ACTIONS;
- MASS ACTIONS;
- REPRESENTATIVE ACTIONS;
- PRIVATE ATTORNEY GENERAL ACTIONS.
20. California Waiver
To the extent applicable, users waive California Civil Code Section 1542, which states:
A general release does not extend to claims which the creditor does not know or suspect to exist.
Users expressly waive any similar protections under applicable law.
21. Force Majeure
Handy shall not be liable for delays or failures caused by circumstances beyond reasonable control, including:
- natural disasters;
- acts of government;
- internet outages;
- cyberattacks;
- labor disputes;
- power failures;
- pandemics;
- failures of third-party providers.
22. Suspension and Termination
Handy may suspend or terminate any account at any time, with or without notice, for any reason or no reason.
Users may stop using the Service at any time.
23. Governing Law
These Terms shall be governed exclusively by the laws of Spain.
Conflict-of-law principles shall not apply.
24. Severability
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
25. Entire Agreement
These Terms constitute the entire agreement between the parties regarding the Service.
